That's probably because the NSView (the main, file-viewing window contents -- hemmed in by the toolbar at the top, the sidebar on the left and the status/info bar from the bottom) in a search box or smart folder is Cocoa as opposed to Carbon for normal Finder windows. They are supposed to behave the same for the most part, but there are a few minor differences that I've seen pointed out in the past but can't quite recall at the moment.
