WRT to Live Verification, the article "Using Disk Utility in Mac OS X 10.4.3 or later to verify or repair disks" at http://docs.info.apple.com/article.html?artnum=302672 states that "Live Verification only works on Mac OS X Extended (Journaled)-formatted (HFS+J) volumes. If you try to verify a non-journaled disk, Disk Utility will display this message: "ERROR: could not freeze volume (Operation not supported)."

I got bit by that during beta-testing this build. I can understand HFS+, but journaling? That's beyond my comprehension.

Journalling would likely allow the system to stop writing changes while Disk Utility is doing the scan, then resume writing those changes to the disk once the scan is complete.

(At least that is my semi-educated guess)

Re: But, if journaling is off, it doesn't have to stop writing.

Interestingly, my HDD was Journaled before the update, and on checking out the new boot volume verification feature of Disk Utility got the 'could not freeze vollume' error. I found that journaling was no longer on. I have reapplied journaling and now the Disk Utility feature works.
