It doesn't just generally work, it always works. The new window on Dock click is because clicking on a Dock item is the same as double-clicking the icon for an open application in the Finder - it sends an AppleEvent that basically means "reopen" (I don't remember the code). This tells the application that you're trying to re-open it, so it should display a new window if there's nothing showing. Whereas Command-Tab just sends the process to the front without sending it the "reopen" AppleEvent, so it doesn't open a new window.
