But couldn't Apple make sure that built-in shortcuts have higher priority than installed ones? They should.

No, they shouldn't. A third party app should be able to override system default keys. If you as a user don't want it overridden, just don't install that third party app. If Apple prevented keyboard overrides, they would be making the decision for all users. As it is, it is up to you if you want to install software that overrides defaults or not.

Um, no they shouldn't, and most especially they shouldn't without notifying you and letting you say no.

The "if you didn't want X, you shouldn't have done Y" attitude smacks of the typical snotty UNIX elitism crap the Mac community has had to put up with since OS X first came out.
