You can just cd to .Trash/ and rm them. Thats what I always do. Why would those flags get set that way?

Even the superuser can't remove a file with the uchg flag set. When you lock a file, Mac OS X sets this flag. The whole idea of locking is to prevent a file from being modified or deleted after all.
