10.7: A warning about Finder's 'Replace' feature

It's a dangerous behavior but I don't understand why it works - after all, a folder and a file are different kind of "files" and that's why you can create a pdf, jpg etc. in the same location with the same names.
Also, I could not replicate the issue. On Desktop, I created a folder 'test', saved a plain text file named 'test' in the folder, then moved the file to the Desktop and it works: file 'test' is moved from the folder to the desktop.

Maybe the file has to have no ending to replace the folder (made in command line with e.g. 'touch')? (my file was 'test.txt', with file ending hidden in Finder). Any comments on how to reproduce the issue?
