for those interested, the easiest solution to this problem is set up a hot key for private browsing:
  1. Open the System Preferences app
  2. Select the Keyboard preferences pane
  3. Select the Keyboard Shortcuts tab
  4. Click the + buton
  5. Make sure the Application pulldown menu says Safari
  6. Enter the phrase Private Browsing... in the Menu Title text box
  7. Enter a keyboard shortcut (shift-command-P works)
viola!

if in step 6 instead of Private Browsing... you enter Private Browsing (without the ...) then the same shortcut can be used to turn both on and off and this time without any warning messages
